When you subscribe to our services, you are subscribing to a pre-paid service. All payments will be charged using either Visa/Master Credit Cards, PayPal, Moneybookers, Perfect Money, Bitcoins, Western Union or WebMoney. Renewal notices are sent several times via email from 7 to 15 days before the renewal date. Accounts 5 days past due will be disabled. Accounts 15 days past due will require a £10.00 GBP fee to enable. We may terminate accounts anytime due to pending invoices or non-payment. In the event that your yearly charge is denied and we are unable to contact you, then the fees above to enable your account shall apply. Please address any questions regarding payment to HostMeNow® Sales.
If you wish to cancel your services, you must write to Sales or request a Cancellation from your client area. If you cancel your account and your payments still continue for any reasons such as
-by fault of the payment processor doing an auto renew
-by fault of any other payment collection company
we are not responsible for any overdraft fees that are issued by your financial institution. It is your responsibility to make sure that you have cancelled any auto renew on whatever payment processor that was being used at that time to charge you.
All new web hosting accounts purchased are set up instantly by our system. You will receive 4-5 emails including login details after your purchase activation. Due to unforeseen complications with various mail servers and any connection problems between your ISP and HostMeNow®, this process may sometimes be delayed.
If for any reason, HostMeNow® detected that you are violating the terms or found in misbehaving activities or talking negatively against our company website in the gain of lowering the reputation of our company. Then your account will be suspended, and you will have to email a letter in which you accept your mistake and agree to pay £50 penalty before the suspension is lifted. All suspended accounts will subject to deletion after 7 days if we not get the required documents and payment on time.
HostMeNow® may document the cases of copyright infringement upon which we act. We will notify subscribers if their materials have been removed as a result of an alleged copyright infringement. We will accept no liability to any Customer of the Services for the removal of any such material. These provisions also require us to give the subscribers an opportunity to send a written notice to us stating that their material has been wrongly removed. If a subscriber does indeed provide a proper “counter-notice” to the initial claim we will follow the counter-notice.
HostMeNow® makes no endorsement, claims, or promises regarding the services offered by our customers and will not be held liable for any disputes or claim against said customers. The use of the HostMeNow website is entirely at the risk of the customer: HostMeNow® shall not be held liable for any direct, indirect, incidental, consequential, special and exemplary damages, or any damages whatsoever, arising from the use or performance of this website or any information, services or products provided through your website. We are not responsible for any content on any server in our network and will not take any action against any questionable material or action until the website in question is brought to our attention by emailing us. We are also not responsible for any disruptions/downtime that a clients website could potentially face or any revenue loss that is caused by this.
ACCEPTABLE USAGE POLICY
You shall use HostMeNow's services only for lawful purposes. Transmission, storage, or presentation of any information, data, or material in violation of the laws of the United Kingdom is prohibited. This includes, but is not limited to: copyrighted material in which you are not the copyright holder, material that is threatening or obscene, or material protected by trade secrets or other statutes.
You agree to indemnify and hold harmless HostMeNow from any claims resulting from the use of the service which damages you or any other party. Moreover, against liabilities arising out of, any injury to person or property caused by any products sold or otherwise distributed in connection with a “HostMeNow” server; copyright infringement or any material that is supplied by a customer which is infringing or allegedly infringing on the proprietary rights of a third party. HostMeNow reserves the right to terminate Services for any customer or End User activity that exposes it to legal liability or endangers its ability to provide services to other customers. The contents, links, or actions on any Services listed below are a violation of this Agreement. This is not an exhaustive list, but is designed to assist you in evaluating whether HostMeNow® is the appropriate service provider for you:

UNLIMITED USAGE POLICY & DEFINITION
Unlimited" refers to the amount of non-restricted resources available on HostMeNow's hosting plans. (For example - unlimited bandwidth, unlimited disc space, unlimited emails or other unlimited resources). Since we don't set limits on key resources, we can provide our customers with more than they need. Essentially, saving you money in the long run as your websites demand more and more.
When a service is marked as "Unlimited," it is intended to be used for regular web hosting purposes only; Any usage outside of this is prohibited. E.g. using our unlimited plans for file storage (e.g. NextCloud). Any excessive usage of our resources outside of normal use patterns is prohibited. (If your start reaching your hosting plans limit in resources. We will make every effort to transfer you to a higher spec plan). Nevertheless, if there is excessive usage of resource that may negatively impact overall server performance, HostMeNow, reserves the right to take appropriate measures. Such actions may include (Termination of any and all offered services, deletion of customers websites/website content, databases, electronic-mail or termination of the customer's account.
BACKUPS, Data theft, loss or disclosure
HostMeNow®, performs daily backups however no guarantee is made of the integrity of these backups. The backups are made for restoration purposes only, and it is the client's responsibility to create backups and to maintain local copies of there web content. No backups of emails or any media data within them are performed, so be sure to make your own email backups if necessary. We do not accept liability for the loss or misuse of clients data. We strongly advise customers to have local backups and to perform routine copies of their web and email content. A client can create web backups using cPanel and then download a copy to a local drive. For email backups a client can perform backups within the "Horde" portal by right clicking on each folder and selecting "Export". We will attempt to assist a client to recover lost data from our most recent archive; however, we offer no guarantee. We do not accept liability for the loss or misuse of customers data.
Money Back Guarantee
If for any reason you are unhappy with the service that you receive, you are then entitled to a 30-Day Money Back Guarantee provided you don't have any other accounts and that it is your first time signing up with HostMeNow, if you've had an account with us before but cancelled and signed up again, you will not be eligible for a refund. Once the guarantee expires it cannot be revitalised. Please note that the money back guarantee applies towards website hosting purchases only. If you purchase hosting using Crypto, then you will be receive in-client credits, and can use these to purchase any other product or services on our platform.
You agree that you will not avoid/go around the restrictions on the 30-Day Guarantee by any means. The following will void the warranty are as follows:
• If you are the target of a DDoS attack during the 30-Day Guarantee period or use up an extremely large portion of the bandwidth that may affect other users performance.
• Creating multiple accounts, using different names and account information or same information;
• Cancelling your account for the sole purpose of obtaining a refund and then registering again for a new account;
• Knowingly providing false information when registering your account;
• Purchasing or attempting to buy domains or hosting with the purpose of defrauding others;
We reserve the right to change the terms of the 30-Day Money Back Guarantee without notice.
Returns and Refunds (Enot.io Payment Gateway)
Product Non-Delivery or Order Unfulfillment: If, due to any unforeseen circumstances or errors on our part, your purchased product through the 'Enot.io' payment gateway is not delivered to you or cannot be fulfilled, you may be eligible for a refund.
Return Period: To request a return for non-delivery or order unfulfillment of website hosting services through the 'Enot.io' payment gateway, you must notify us within 30 days from the date of your purchase.
How to Apply for a Return: To request a return for website hosting services, please contact our customer support team via billing using a support ticket. Provide them with your order details and a clear explanation of the issue you are facing.
Return Method: Upon approval of your return request, you will have the option to receive your refund in the following ways:
a. Account Balance: Your refund can be credited to your HostMeNow account balance, which can be used for future hosting purchases on our platform.
b. Bank Card/Wallet: You can choose to have the refund processed to the original payment method you used for the purchase through the 'Enot.io' payment gateway.
Exceptions: Please note that this return policy applies exclusively to Enot.io customers only.
Additional Terms: Any returns requested due to DDoS attacks, high bandwidth usage, multiple accounts with the same or false information, or fraudulent activities will not be considered under this section but will be subject to the main Money Back Guarantee policy.
Policy Changes: We reserve the right to modify the terms of this return policy without prior notice, following any changes to Enot.io guidelines. Please review the policy periodically for any updates.
